1) Definitions

Guest / You: The person making the reservation and any additional occupants or visitors.

Host / We / Us: The owner/operator/manager of The Nest at Turkey Cove.

Booking Platform: Any third-party service used for reservations, payments, messaging, or policies.

2) Use of Website

You agree to use our website for lawful purposes only. You may not misuse the website, attempt unauthorized access, disrupt the website, or use it to transmit harmful code.

Website content is provided “as is” and may change at any time without notice.

3) Reservations & Booking Terms

Reservations may be made directly with us or through a Booking Platform. All reservations are subject to:

Any additional house rules, check-in instructions, or property-specific guidelines provided before or at check-in

If you book through a Booking Platform, you also agree to that platform’s terms and policies. If there is a conflict, the platform’s required terms may apply to payments, cancellations, and disputes processed through the platform.

4) Payments, Fees, Taxes, and Holds

Rates, taxes, and fees (including cleaning fees, service fees, and optional add-ons) may apply and will be disclosed at booking or before payment is processed.

We may authorize a hold or collect a security deposit/damage waiver, depending on the booking method and platform requirements. You agree that we may charge the payment method on file for:

Damage beyond normal wear and tear

Missing items

Excessive cleaning

Rule violations

Unpaid fees or taxes

Costs incurred due to unauthorized occupancy, events, pets, smoking, or other prohibited activity

5) Cancellations & Refunds

Cancellation and refund terms vary depending on how you book:

If you book through a Booking Platform: the platform’s cancellation policy generally controls.

If you book directly with us: the cancellation terms will be disclosed in writing at booking confirmation.

We strongly recommend travel insurance. Refunds are not guaranteed for weather, travel disruptions, illness, or early departure unless required by law or explicitly stated in writing.

6) Check-In / Check-Out

Check-in and check-out times, access instructions, and any arrival requirements will be provided prior to arrival. Early check-in and late check-out may be possible but are not guaranteed and may involve additional fees.

7) Occupancy, Visitors, and Events

For the comfort and safety of all guests and neighbors:

The Property has a maximum occupancy limit, which will be provided before check-in or in the listing details.

Visitors may be limited or restricted based on the Property rules shared at booking.

Parties, events, commercial use, and gatherings may be prohibited or require written approval.

We reserve the right to end a stay if occupancy limits or event rules are violated.

8) House Rules & Property Guidelines

You agree to follow all house rules and guidelines provided in the listing, booking confirmation, welcome guide, posted signage, or messages from us.

Common examples (without limiting our rules) may include restrictions related to noise, parking, trash, smoking, pets, fires/grills, and use of amenities.

9) Care of the Property

You agree to:

Keep the Property in good condition

Use furniture, fixtures, appliances, and amenities safely and as intended

Report damage, spills, leaks, or safety issues promptly

Not rearrange or remove items in a way that risks damage

You are responsible for damage caused by you or anyone in your party, beyond normal wear and tear.

10) Safety, Risk, and Assumption of Responsibility

Staying at a vacation property involves inherent risks (including but not limited to stairs, decks, wet surfaces, outdoor areas, water features, grills/fireplaces, and natural surroundings).

You assume responsibility for your own safety and the safety of your party, including children. You agree to use the Property and any amenities at your own risk and in compliance with all posted warnings and instructions.

11) Maintenance, Repairs, and Access

We may enter the Property as reasonably necessary for maintenance, repairs, inspections, emergencies, or to address rule violations. When practical, we will provide notice; however, immediate entry may be required in emergencies.

We will make reasonable efforts to address maintenance issues, but we do not guarantee uninterrupted access to utilities, internet, or all amenities.

12) Utilities, Internet, and Service Interruptions

We are not responsible for temporary interruptions to utilities or services (including internet, TV, water, power, HVAC) due to weather, local outages, or service provider issues. Unless required by law, such interruptions do not automatically entitle Guests to refunds.

13) Cleaning, Trash, and Extra Charges

Cleaning standards and checkout steps will be provided prior to departure. You agree that additional fees may apply for:

Excessive mess or stains

Smoke odors

Unauthorized pets

Trash overflow or improper disposal

Biohazards or unsafe conditions

Extra cleaning beyond standard turnover

14) Prohibited Activities

You may not:

Engage in illegal activity

Damage or vandalize the Property

Tamper with safety devices or locks

Bring hazardous materials or weapons used unlawfully

Disturb neighbors or violate local noise ordinances

Use the Property for commercial purposes without written consent

Violation may result in immediate termination of the stay without refund.

15) Security Devices and Privacy

For safety and property protection, we may use security devices such as smart locks, noise monitoring devices (that do not record conversations), and/or exterior cameras in permitted areas.

We do not allow interior cameras in private spaces.

Any device usage will comply with applicable laws and will be disclosed in listing/booking details where required.

16) Lost & Found

We are not responsible for lost or stolen items. If an item is found and you request return shipping, you agree to pay shipping and any reasonable handling costs.

17) Limitation of Liability

To the fullest extent permitted by law, we are not liable for any injury, accident, illness, loss, theft, or damage to persons or personal property arising from your stay, your use of the Property, or circumstances beyond our reasonable control.

18) Indemnification

You agree to defend, indemnify, and hold harmless The Nest at Turkey Cove and its owners/operators from claims, damages, liabilities, losses, and expenses (including reasonable attorney fees) arising out of your stay, actions, or violation of these Terms.

19) Force Majeure

We are not responsible for delays, cancellations, or disruptions caused by events beyond our control, including severe weather, natural disasters, acts of government, utility outages, or other force majeure events. Any refunds or credits are subject to applicable law and the booking channel’s policies.

20) Changes to These Terms

We may update these Terms from time to time. The version effective at the time of booking will generally apply to that reservation, unless a change is required by law. Updates will be posted on our website with the revised “Last Updated” date.

21) Governing Law and Disputes

These Terms are governed by the laws of the state/jurisdiction where the Property is located, without regard to conflict-of-law rules. Venue for any dispute will be the appropriate court in that jurisdiction unless otherwise required by law.
